Terms & Services
Effective date: October 1, 2025
These Terms & Services ("Terms") govern your access to the website located at depravedtube.com (the "Site") and any inquiry, estimate request, or service engagement with DepravedTube Homes ("Company," "we," "us," or "our"). By using the Site or engaging our home improvement services—including roofing, remodeling, painting, siding, window replacement, and related construction activities—you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Scope of home improvement services
DepravedTube Homes provides residential and light commercial property improvement services. Specific work is defined only in a written proposal, contract, or change order signed or electronically accepted by you ("Service Agreement"). Website descriptions, portfolio images, blog articles, and verbal conversations are illustrative and do not constitute a binding offer until confirmed in a Service Agreement.
Services may include demolition, structural modifications, roofing tear-off and installation, interior and exterior painting, installation of fixtures, cabinetry, flooring, windows, doors, gutters, decking, and ancillary tasks such as debris removal, site protection, and final cleaning. We may subcontract specialized trades while remaining responsible for coordination unless otherwise stated in writing.
1.1 Estimates and inspections
Estimates are based on visible conditions and information you provide. Hidden damage—such as rotted decking beneath shingles, outdated wiring behind walls, or out-of-code plumbing—may require change orders after discovery. We document unforeseen conditions with photographs and explain impacts to schedule and cost before proceeding when feasible.
1.2 Permits and inspections
When permits are required, we identify them in your proposal. Unless you opt out in writing where legally permissible, we arrange permit applications and schedule municipal inspections. Permit fees are typically billed as pass-through costs. Failure to obtain required permits due to client instruction may void certain warranties and shift liability for code violations.
2. Client responsibilities
You agree to provide safe access to the property, utilities as needed, and timely decisions on selections (shingles, paint colors, hardware, etc.). Delays in approvals may extend the project timeline and incur standby or remobilization charges if stated in the Service Agreement.
- Secure pets and inform us of sensitive landscaping or interior areas.
- Remove or protect personal belongings in work zones; we are not responsible for items left in active construction areas.
- Disclose known hazards including asbestos, lead-based paint, mold, or unstable structures.
- Ensure decision-makers are available for mid-project questions within agreed response windows.
3. Pricing, deposits, and payment
Prices in marketing materials are starting points only. Your Service Agreement lists labor, materials, allowances, taxes, and payment milestones. Deposits reserve crew availability and purchase long-lead materials; they are non-refundable once ordering or scheduling begins, except where prohibited by applicable law.
Progress payments may be tied to measurable completion stages (e.g., dry-in, rough inspection, substantial completion). Final payment is due upon completion of punch-list items agreed as substantial completion, unless disputed items are documented in writing within five business days. Late payments may accrue interest at the lesser of 1.5% per month or the maximum rate allowed by law, and may pause work until accounts are current.
3.1 Change orders
Any modification to scope, materials, or sequence requires a written change order describing cost and time impacts. Verbal requests may be accommodated when urgent (e.g., emergency leak mitigation) but will be formalized in writing as soon as practicable.
4. Warranties and manufacturer coverage
DepravedTube Homes provides a workmanship warranty as specified in your Service Agreement, commonly ranging from ninety days for minor repairs to one year or more for major installations. Manufacturer warranties apply to shingles, windows, paint systems, and other packaged goods; we register eligible products when included in scope and provide documentation you need to maintain coverage.
Warranties do not cover damage from storms, improper maintenance, third-party alterations, pest infestation, or normal wear. Warranty claims must be reported promptly with photos and description of the issue. We will inspect and, at our discretion, repair qualifying defects or coordinate manufacturer remedies.
5. Insurance, liability, and indemnification
We maintain general liability and workers' compensation insurance appropriate to our operations. Certificates are available upon request for active projects. To the fullest extent permitted by law, our total liability for any claim arising from services shall not exceed the amounts paid by you for the specific project giving rise to the claim, except in cases of gross negligence or willful misconduct.
You agree to indemnify and hold harmless DepravedTube Homes, its officers, employees, and subcontractors from claims arising from inaccurate information you provide, failure to disclose hazardous conditions, or interference with work performed according to the Service Agreement.
6. Website use and intellectual property
Content on the Site—including text, logos, graphics, project photography, and layout—is owned by DepravedTube Homes or licensed to us. You may view and print pages for personal, non-commercial use. You may not scrape, republish, or create derivative works without written permission.
Project photos may depict real client properties with permission; do not assume identical results on your structure without a site-specific evaluation. Trademarks and service marks displayed belong to their respective owners.
7. Electronic communications and marketing
By submitting forms on the Site, you consent to receive responses related to your inquiry via email. Marketing emails are sent only when you opt in through our subscribe page or equivalent consent mechanism. You may unsubscribe using the link on any promotional message or via our Unsubscribe Email page. Transactional messages about active projects may still be sent as necessary.
8. Dispute resolution and governing law
We prefer to resolve concerns through direct conversation with your project manager and leadership team. If a dispute remains unresolved, the parties agree to attempt mediation before pursuing litigation, when mediation is available in your jurisdiction.
These Terms are governed by the laws of the state or province where the project property is located, without regard to conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. Venue for any permitted court action shall be in the county or district of the project property.
9. Cancellation and rescheduling
Weather, material shortages, inspector availability, and safety conditions may require rescheduling exterior work. We communicate revised dates promptly. Client-initiated cancellation after materials are ordered or crews are reserved may result in charges for restocking fees, labor already performed, and non-refundable deposits as outlined in the Service Agreement.
10. Privacy
Personal information collected through the Site and during projects is handled according to our Privacy Policy, which is incorporated into these Terms by reference.
11. Changes to these Terms
We may update these Terms to reflect new services, legal requirements, or business practices. The effective date at the top will change when revisions are posted. Continued use of the Site after updates constitutes acceptance. Service Agreements in progress remain governed by the Terms in effect at signing unless both parties agree otherwise in writing.
12. Contact
Questions about these Terms may be sent to legal@depravedtube.com or through our Contact Us form. We do not provide legal advice; consult your attorney for interpretation specific to your situation.
